Booking Confirmation:
All appointments will be confirmed by the Photographer prior to the scheduled time.
Delivery Timeframe:
Next-day delivery applies only on business days.
Additional Fees:
Any additional charges will be communicated to the Client before services are performed.
Client Responsibility:
It is the Client's responsibility to inform any relevant parties (vendors, tenants, landlords) of the scheduled appointment time.
Cancellation Policy:
If a property is unattended at the time of arrival and access is not possible, a cancellation fee amounting to 50% of the total booking value will be applied.
Delivery of Works:
Completed works will be provided to the Client electronically via email or text message.
Inspection of Works:
The Client agrees to inspect all delivered works and report any defects to the Photographer within 24 hours. Failure to notify the Photographer within this period will release the Photographer from any liability for defects.
Health and Safety Compliance:
The Photographer will adhere to all applicable health and safety laws and practices, as well as show respect for the property and people involved. The Photographer will not be held liable for any areas of the property not photographed due to health and safety concerns. The Photographer�???????????????????????�??????????????????????�?????????????????????�????????????????????�???????????????????�??????????????????�?????????????????�????????????????�???????????????�??????????????�?????????????�????????????�???????????�??????????�?????????�????????�???????�??????�?????�????�???�??�?�¢??s liability is limited to the professional fees paid by the Client for that specific shoot, including in cases of Force Majeure. Permissions and Indemnity: The Client must ensure that all necessary permissions and legal rights to access the property have been obtained. The Photographer is not liable for any incidents or damages occurring during the shoot. The Client agrees to indemnify and hold the Photographer harmless from all claims, damages, and legal costs arising from photographing the property. Copyright and Usage: The Photographer retains all copyright and ownership of photographs, videos, floor plans, or graphics created. The Photographer may use and display these materials in any format or medium, including websites, brochures, and social media. The Client acknowledges and agrees that they waive any claim to profits from the use of these materials.
Model Release:
The Client warrants that all individuals appearing in the photographs have consented to being photographed. The Photographer has the irrevocable right to use and publish any images that include the Client or associated individuals, including alterations, copyrights, and licensing. The Client agrees to indemnify the Photographer against any claims resulting from the use of these photographs.
Usage License:
The Client may use the photographs, videos, floor plans, or graphics only as outlined in a License Agreement or full purchase. This usage is limited to promotional or advertising purposes directly related to the listing of the property and expires once the property is no longer being marketed for sale, rent, or lease. The license is non-transferable and cannot be resold or assigned. Breach of this agreement will result in the immediate termination of the license.
Termination:
Termination of this Agreement or a License Usage Agreement does not affect any rights or actions that have accrued due to a breach prior to termination.
Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain effective and be revised as necessary to remain enforceable. Failure to exercise or delay in exercising any right does not constitute a waiver of that right.
